Tuesday 23rd Dec. 2003 - James Taylor returns to share all of his first hand knowledge about the Middle East.

During WW II James served as a staff officer under Rear Admiral Rodgers and James was wounded during the battle of Iwo Jima - James spent a year in Japan as part of the occupation force and was then sent to Shanghai where he served until he had to escape to Hong Kong after the Chinese Communist overran Shanghai -- He was at Dien Bien Phu when the French surrendered in Indo-China - He was arrested by the KGB in E. Germany - He was close friends with King Hussein of Jordan - He spent 4 months with Col. Khadafy of Libya - He's known Arafat for 30 years and met with him many times - James was part of the effort to get AP's Terry Anderson released from captivity in Lebanon - During the Iran-Iraq War James wrote publicity for Saddam Hussein - James was in the room when Donald Rumsfeld, on behalf of Pres. Regan bestowed great praise on Saddam - James was also present when Rumsfeld met with Iraq's foreign minister Tariq Aziz - James Taylor has personally talked with Osama Bin Laden and has been on over 2000 TV and Radio programs - James' books have won six international awards and the International Mark Twain Society award in St. Louis. - He was senior editor for TV Guide for 25 years

Last Thursday the 18th of December, James talked to us about his book on the Israeli attack on the USS Liberty and the following cover up by our US government. Just this last month the USA admitted the cover up. Listen to the archived show for the 18th for a very interesting history lesson.

The Arizona Breakfast Club will not be meeting the Saturday after Christmas on the 27th of December. The 3rd of January is an open planning meeting for the Arizona Breakfast Clubs 35th year. One man in Texas has taken a stand with regard to payroll tax withholding and is currently in jail facing a criminal tax trial on January 5, 2004. His name is Richard (Dick) Simkanin. Here’s the story that should be of interest to your Libertarian listeners/subscribers and hopefully motivate many of them to take a few minutes to write a letter to Mr. Simkanin.

His first trial last month was declared a mistrial. The jury deliberated for 8 hours and could not render a unanimous verdict. They were unofficially polled immediately after the trial and it was learned they voted 11-1 to ACQUIT. The one person who would not vote to acquit was asked privately why he voted the way he did: because he did not think the defendant appeared remorseful. (Difficult to be sorry or remorseful if you truly believe you’re innocent!)

During deliberation they asked the judge for nine different items to assist them and clarify things as they were trying to make up their minds and get a unanimous decision. One item asked for was a written copy of the jury instructions. The judge denied it and told them he had given the instructions to them verbally the day before. Another item they requested was a copy of the Internal Revenue Code section (the law) that required the defendant to withhold income tax from the pay of his workers. The judge denied that one too!

Mr. Simkanin recently said that he is very encouraged by the letters that are coming in and that the volume has really caused a positive notice by the people at the prison facility. He’s hoping the volume will increase and that people will pour it on.

I’m hoping you will publicize this to whatever extent you think appropriate.

James Taylor is the author of Pearl Harbor II, detailing what was known and by whom when Israel attacked (several times) the USS Liberty in the Mediterranean. Only now has the US released confirmation that it was no accident.

What role did John McCain’s father have in the investigation and why?

James Taylor served in the US Navy and later was asked to work for our then ally Iraq in the early 1980’s in public relations. Mr. Taylor was in the room with Saddam and Rumsfeld during Rumsfeld’s visit and remembers what was said.

Historian Harvey Klehr discusses his book, In Denial: Historians, Communism, and Espionage, published by Encounter Books. Mr. Klehr and co-author John Earl Haynes were the first American historians to utilize the recently opened archives of the former Soviet Union in their research.

According to Mr. Haynes, the study of communism in America has been taken over by revisionist historians, who attempt to portray American communists in a favorable light and downplay the threat posed by communism to American democracy. In the book, the authors also examine the ways in which evidence of links between the U.S.S.R. and the American Communist Party have been ignored or modified.

At stake is who decides how the party is organized, and other internal party matters, and whether Libertarians or non-libertarian voters (who outnumber Libertarians 25 times over) control the party.

The 9th Circuit Court of Appeals has rendered a muddy decision that would seem to limit an increase in freedoms to only the Libertarian Party of Arizona in an effort to maintain internal controls on those that have yet to challenge the state's violations of 1st Amendment Rights of Association. This case will have long term and wide effect on the election process in Arizona and around the country.

Terry Bressi refused to cooperate when forced over at a "papers please" check point near Kitt Peak Observatory. Terry works for the University of Arizona and does research at the observatory. Being a libertarian, a regular traveler on that particular stretch of road and seeing what was going on with all of the governmental agencies that were there. He said no and the battle began. John Turner Served as an IRS revenue officer (RO) for ten years. RO's are civil enforcement agents, and tax collectors. They take administrative enforcement actions to include such things as filing notices of lien, levy, seizure and sale of property, issuing summonses, etc.

IRS employs a large body of people who work in support of what revenue officers do. Currently, as an enrolled agent (EA) John Turner consults with people who have federal tax problems and represents people before the IRS. (http://www.naea.org)

John Turner would probably still be working for IRS until his first opportunity for retirement, if a certain set of circumstances had not occurred: He was challenged to disprove certain claims about who is required to file and pay income taxes, and what law makes one liable for the income tax, chief among them. Sincerely, but naively, he set out to do just that. Result: He quietly submitted his resignation 4 months later (in April, 1997).

John has pretty much proven what many are saying in various ways about the voluntary nature of the income tax; that it does not apply to most Americans. The IRS claims to have the legal authority to be able to make a return for someone who is required to file a return, but fails to do so. The truth is, they do not. Of course, a major problem is that they take actions against people anyway in spite of the limited scope which should protect most people. The IRS generally does what it chooses to do.

Mark Brnovich is the new Director of the Center for Constitutional Government at the Goldwater Institute.

As director of the new Center for Constitutional Government, Brnovich spearheads the Institute?s research in the areas of electoral reform, property rights, regulatory and administrative law, judicial oversight, federal-state relations and civil liberties. He also hosts forums and conferences on legal issues and is available as a public speaker.

Before being hired by Goldwater, Brnovich served for five years as an assistant attorney general for the State of Arizona, and six years as a deputy county attorney for Maricopa County. He holds a law degree from the University of San Diego Law School and majored in political science at Arizona State University. At San Diego, he served as a research assistant to Prof. Bernard Siegan, one of the nation's foremost scholars in the area of constitutional property rights law.

A People Armed and Free: The Truth About the Second Amendment is a new book written using plain, common language, easy to understand. It goes through six factors that the courts consider in determining the meaning of constitutional provisions: The text itself, the history of the Amendment, the structure of the government, previous court decisions, public policy, and the ethos of the American people. The applicability of the Fourteenth Amendment to restrict the states' efforts to regulate gun ownership, the current status of federal gun regulation and current proposals for more regulations and their possible constitutionality are also discussed.

Unlike most books, this book looks at all of the arguments, from all sides, and makes a decision, as an appellate judge would do after reviewing briefs and hearing arguments, only cutting through the legalese.

The author, Jack Reynolds, J.D., has been a practicing attorney in Houston, Texas since November 1983. He is licensed in both Texas and Utah, and practices before both state and federal courts. He is also licensed before the Fifth Circuit Court of Appeals. He is Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization. He graduated cum laude from the University of Houston School of Law in 1983, where he served as a research editor on the Law Review. He retired as a lieutenant colonel infantry officer in the Marine Corps Reserve. Active in his church and community, he has a wife and three children at home, whose freedoms and physically security he is determined to protect.

Since the forming of the United States, people of color like Africans, Native Americans, and the Chinese were prohibited from owning a gun. (You can't enslave a man with a gun.) These people were legally killed, tortured and imprisoned for having any parts of a firearm. Since 1640, laws were created to keep non-whites from owning guns. Most of us have been conditioned not to do so economically, stereotypically and politically. The days of slavery, the Civil War, Reconstruction, World Wars, and the Civil Rights era bought with it more restrictions. These laws have never been lifted. They are reinforced every night on the evening news, which is slanted to sell papers, raise eyebrows and make money for advertisers.

Jack Cole retired from the New Jersey State Police as a Detective Lieutenant with 26 years of exemplary service. 12 of those years were as an undercover narcotics officer. Mr. Cole saw the huge effect on the justice system of the Drug War, the effect on urban communities, and the effect on our budgets. He now travels tirelessly to present his ideas to civic groups, religious leaders, and legislators across the country.

In a recent op-ed Jack wrote to a city newspaper, Jack said: "After three decades of fueling the drug war with over half a trillion of our tax dollars and increasingly punitive policies, our court system is choked with ever-increasing drug prosecutions. Our quadrupled prison population has made building prisons this nation's fastest growing industry; with 2.2 million incarcerated today and another 1.6 million arrested every year?more per capita than any country in the world. Meanwhile, drug barons and terrorists grow richer every year, people continue dying on our streets, and today, illicit drugs are cheaper, more potent, and easier to get than they were 33 years ago when I first started buying heroin on those streets. To me, this represents the very definition of a failed public policy. It is time to find alternative strategies."

Elaine Cassel is an attorney, freelance writer, and professor of law at Concord University School of Law, where she teaches administrative law and health law courses in the LLM program in Health Law. She also teaches graduate courses in law and psychology at Marymount University. She practices law in Virginia and the District of Columbia. She graduated from George Washington University Law School and has graduate degrees in English Literature and psychology. She has authored a textbook in criminal psychology (Criminal Behavior, Allyn & Bacon, 2001), and writes frequently in areas related to psychology and the law. George Nicholas Bryant, 15, and Nyssa Bryant, 13, stood behind their parents, Kim and George, as police and DSS workers attempted to collect the children at 7:45 a.m. DSS demanded that the two complete a test to determine their educational level. After a court order was issued by Framingham Juvenile Court around 1 p.m., the children were driven by their parents to a Waltham hotel. Again, they refused to take the test."

Matt Cheselka is an Arizona resident and member of the Board of Directors of the Free State Project. By the end of this summer it is expected that the FSP will select a low population state to begin moving in at least 20,000 liberty-oriented pioneers/activists. This, the FSP feels, will have much influence in reducing the size and scope of government on the state level, which is the smallest autonomous entity specified in the US Constitution. The ultimate goal is to demonstrate the benefits of liberty to the rest of the country and restore constitutional federalism on a national level.

Jim Lesczynski made international news when he and other libertarian activists handed out toy water pistols in Harlem, New York in response to the City Council passing a ban on such toys while they should have been allowing for real firearms to be sold to the people so that they could protect themselves.

Kathy and her family lost everything due to forest mismanagement here in Arizona. They are working to make certain it doesn't happen again to them or anyone else. Seeking to get the government out of the micro-management of the forests she came across a common thread among enviromentalist... everyone she came into contact with were socialist. The media, the activist, the government representatives were all working against the private property owner and the real interest of the forest itself.... she worked to find out what was really going on behind the scenes. Research brought her to some interesting discoveries.
